1. Who you are contracting with

These terms form a binding agreement between you and Curtis David Maughan, an individual sole trader based in the United Kingdom, trading as stillwater("we", "us", "our"). Contact: curtis.maughan94@gmail.com.

2. Acceptance

By creating an account or otherwise using stillwater, you agree to these Terms. If you do not agree, do not use the service. You confirm that you are at least 16 years old (or of the age of majority in your jurisdiction) and, where you use the service on behalf of an organisation, that you have authority to bind it.

3. The service

stillwater provides daily mood tracking, guided breathing exercises, journaling tools, an AI-powered companion and related wellbeing features. The service is provided for general wellbeing and self-reflection purposes only. It is not a medical device and does not provide medical, psychological, diagnostic or crisis care. If you are in crisis or in need of urgent help, please contact your local emergency services or the resources listed on our Crisis page.

4. Your account

  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • You agree to provide accurate information and keep it up to date.
  • You must notify us promptly if you suspect unauthorised use of your account.

5. Acceptable use

You agree not to:

  • Use the service unlawfully or for fraudulent purposes;
  • Send spam, harassing, harmful or unlawful content through the service;
  • Infringe anyone else's intellectual property or privacy rights;
  • Probe, scan, scrape, reverse-engineer, interfere with or attempt to bypass the security or technical limits of the service;
  • Upload malware or anything else designed to disrupt the service or harm other users;
  • Resell, redistribute, sublicense or commercially exploit the service without our prior written consent.

6. AI companion — acceptable use and limitations

The AI companion produces text generated by third-party AI models. You agree that you:

  • Will not use it to generate illegal content, hateful content, sexual content involving minors, malware, deepfakes, or content intended to deceive or harm others;
  • Are responsible for your prompts and how you use the outputs, including verifying accuracy before relying on them;
  • Have, and will continue to have, the rights necessary to share any content you input;
  • Understand that outputs may be inaccurate, incomplete, or out of date and must not be relied on as medical, psychological, legal, financial or other professional advice.

We may filter, restrict or remove outputs, and may suspend accounts that repeatedly or seriously breach these rules. If you believe content generated through the service infringes your rights, email curtis.maughan94@gmail.com with details and we will investigate. Repeat infringement may result in account termination.

7. Your content

You retain ownership of the content you create in stillwater (journal entries, mood logs, messages, etc.). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit and process that content solely as necessary to operate and improve the service for you. We do not use your private content to train third-party AI models.

8. Intellectual property

The service, including its software, design, content and branding, is owned by us or our licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the service for your own personal, non-commercial wellbeing use.

9. Subscriptions, payments and billing

Paid plans are billed in advance on a recurring basis (monthly or yearly) until cancelled. Free trials, where offered, will convert into a paid subscription at the end of the trial unless cancelled before the trial ends.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, invoicing, cancellation and refund mechanics are governed by Paddle's Buyer Terms in addition to these Terms. See our Refund Policy for refund details.

10. Service availability

We work hard to keep stillwater available, but we do not guarantee that the service will be uninterrupted, error-free or always available. We may modify, suspend or discontinue parts of the service at any time.

11. Suspension and termination

We may suspend or terminate your access to the service if you materially breach these Terms, fail to pay subscription fees, pose a security or fraud risk, or repeatedly or seriously violate our acceptable use rules. You may stop using the service at any time and cancel your subscription through the in-app billing portal.

On termination, your right to use the service ends. We will retain or delete your data in accordance with our Privacy Notice.

12. Disclaimers

To the fullest extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in the service constitutes medical, psychological, legal, financial or other professional advice.

13. Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded under applicable law. Subject to that:

  • We are not liable for indirect, consequential, special or incidental loss, loss of profits, loss of data, loss of goodwill or loss of anticipated savings;
  • Our total aggregate liability arising out of or in connection with the service is limited to the amount you have paid us for the service in the twelve (12) months immediately preceding the event giving rise to the claim.

14. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages and expenses (including reasonable legal fees) arising from your content, your use of the service in breach of these Terms, or your violation of any law or third-party right.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email. Continued use of the service after changes take effect means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of England and Wales. Subject to your non-waivable consumer rights in your country of residence, the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

17. Assignment and force majeure

You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delay or failure to perform caused by events beyond its reasonable control.
